These Terms of Use ("Terms") explain the rules for using the Nestra Android app. Nestra is provided by Quietarc Tech LLC ("Quietarc," "we," "us," or "our"). By using Nestra, you agree to these Terms. If you do not agree, do not use the app.

Nestra is intended as a personal productivity and planning tool.
Nestra is not:
Do not rely on Nestra for emergencies, medication safety, legal deadlines, medical decisions, financial obligations, or anything where a missed reminder, notification failure, app error, device failure, data loss, or service issue could cause harm.
Nestra is designed to be local-first. Your planning content is primarily stored on your device. This may include tasks, reminders, rhythms, tags, dates, repeat settings, and app settings.

Nestra is not a cloud backup service and does not provide cloud sync unless we separately add and disclose that feature in the future.
Nestra may allow you to save, share, check, and restore backup files. Backup files are user-controlled files. You decide where to save or share them.
If you share or save a backup through another app or service, that app or service may handle the file according to its own terms and privacy practices.
Restoring from a backup may replace the Nestra data on your device with the selected backup. Nestra may create a safety backup before restore, but you should still keep your own important backups.
You are responsible for protecting backup files and understanding what happens when you restore them.
Nestra may include reminders and notifications. Reminders are provided as a convenience. They are not guaranteed.
Notifications may fail, arrive late, be blocked by Android settings, be affected by Quiet Hours, be affected by device settings, or be affected by battery, network, operating system, or app conditions.
Do not rely on Nestra reminders for emergencies, safety-critical tasks, medication, legal deadlines, medical decisions, financial deadlines, or anything where missing a reminder could cause harm.
The Free version of Nestra may include a sponsored/ad placement, such as a sponsored placement in the Inbox.
Nestra does not show personalized ads and does not use your tasks, reminders, rhythms, tags, backup contents, or planning content to target ads.
Ads, consent tools, and related third-party services may be subject to their own terms and policies.
Pro is intended to remove ads where available.
Nestra may offer optional Pro features. Pro may include benefits such as:
Pro purchases and subscriptions are handled through Google Play Billing. Google Play handles payment methods, billing, renewals, cancellations, refunds where applicable, and subscription management. You can manage or cancel subscriptions through Google Play. Quietarc does not receive your full payment card information from Google Play.
If you cancel a subscription, your access may continue until the end of the current billing period, depending on Google Play's subscription rules and the subscription state.
Refunds, cancellations, and subscription management are subject to Google Play policies.
Nestra may include a "Restore purchases" feature. Restore purchases checks Google Play purchase status and attempts to restore Pro entitlement.
Restore purchases is separate from backup restore. It does not restore planner data, backup files, tasks, reminders, rhythms, tags, or other app content.
We may update, change, remove, pause, or discontinue parts of Nestra at any time. We may change Free or Pro features over time, but we aim to keep the Free version useful and honest.
Some features may depend on Android, Google Play, Google services, device settings, network availability, or third-party services. Nestra may not work on every device or Android version.
You agree not to misuse Nestra. You may not:

Third-party services may have their own terms and privacy policies. Quietarc is not responsible for third-party services we do not control.

Nestra, including its design, branding, text, software, visual style, and related materials, is owned by Quietarc or its licensors and is protected by intellectual property laws. These Terms do not give you ownership of Nestra. You may use Nestra only as allowed by these Terms and applicable app store terms.
If you send us ideas, suggestions, bug reports, or feedback, you allow us to use that feedback to improve Nestra without obligation to compensate you. Do not send confidential information unless we have agreed in writing to receive it.
Nestra is provided "as is" and "as available." To the maximum extent allowed by law, Quietarc disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, reliability, availability, and non-infringement.
We do not guarantee that Nestra will be uninterrupted, error-free, secure, accurate, or free from data loss.
To the maximum extent allowed by law, Quietarc will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost backups, lost reminders, lost opportunities, device issues, service interruptions, or third-party service issues.
To the maximum extent allowed by law, Quietarc's total liability for any claim related to Nestra will be limited to the amount you paid for Nestra in the twelve months before the claim, or $50, whichever is greater.
Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
If your misuse of Nestra, violation of these Terms, or violation of law causes claims, losses, damages, liabilities, costs, or expenses against Quietarc, you agree to be responsible for them to the extent allowed by law.
You may stop using Nestra at any time. We may suspend, limit, or terminate access to Nestra or Pro features if you violate these Terms, misuse the app, attempt to bypass billing or security controls, or if continued access would create legal, security, operational, or platform risk.
Termination does not automatically cancel any Google Play subscription. You must manage or cancel subscriptions through Google Play.
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules, except where applicable consumer protection laws require otherwise.
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Material changes will be described in plain language where appropriate. Your continued use of Nestra after changes become effective means you accept the updated Terms.
